Terms & Conditions of Supply
Please read the following terms and conditions very carefully before placing an order to sell your device. They provide vital information relating to the basis on which we will buy your device. Please note that by submitting an order, you agree to be bound by these terms and conditions and our terms of use. If for any reason, however, you refuse to accept these terms and conditions, please understand that you will not be able to place an order on our website to sell your device.

You may also wish to print and keep a copy of these terms and conditions and the terms of use for future reference.

The following definitions will help you understand the words used in these terms and conditions:

  • “Device” refers to any electronic product such as a mobile phone, tablet or MP3 player (i.e., iPod) that we are willing to purchase.
  • “We/Us/Our” refers to Money For Your Phone Limited.
  • “You/Your” refers to the person, individual or company selling the device to Money For Your Phone Limited.
1. About Us
Money For Your Phone Limited is a mobile phone recycling company providing a service to consumers and businesses where they are able to trade in their phone, tablet and other devices for money or for another device using our "SWAP" service. The phones/devices are then sold on, broken down or given to charity hence completing the recycling process.
2. Who Can Recycle
Our website is aimed at individuals and businesses that are interested in selling or recycling mobile phones/devices. It is mainly intended for users registered with us and resident in the United Kingdom. At our complete discretion we may accept or reject orders from outside of these territories.

We will only accept phones and devices manufactured to operate in the UK. We may, however, at our discretion choose to accept or decline the purchase of devices that are not made to work in the UK.

The information on this website and all communications will be in English. This website and the terms are designed to comply with English law. You may be viewing the website in a country in which we do not operate and trade and we cannot be responsible for non-compliance with any local advertising or other laws in relation to this website or its contents.
2.1. Consumers (Individuals)
By placing an order on our website, you warrant the following:

  • You are a resident in the United Kingdom.
  • You are accessing our website within the United Kingdom.
  • You are at least 18 years old and legally capable of entering into a binding contract.
  • If you are under 18 years of age, you have obtained your parent's or guardian's consent to sell your device to us in accordance to our terms and conditions.
  • You are the rightful owner of the device.
  • We have the right to reject any orders received upon discretion without any reason.
2.2. Businesses
If you are recycling on behalf of a business and are selling more than 10 devices you must email orders@moneyforyourphone.com to get approval. Our website is designed for consumers and we have a limit of 10 devices per customer. You can call us on 0161 387 7118 or email us to get approval.

Any business placing an order will need to warrant the following:

  • You are authorised to act on behalf of the registered business
  • You are based in the United Kingdom.
  • You are accessing our site from the United Kingdom.
  • You are legally capable of entering into a binding contract
  • You agree to the terms of a consumer order.
  • We have the right to reject any orders received upon discretion without any reason.

Consumers and Businesses are advised to read the above carefully and ensure that they understand these terms and conditions.
3. How the Contract is Formed
Your contract with us will be formed when we receive your order. It will incorporate these terms and conditions and our terms of use, and you will be bound by them. You must own all rights for any device that you send to us. Ownership of the device will only pass to us when we receive the device in accordance with these terms and conditions. This forms the agreement.

By submitting an order on our website you warrant that:

  • You are the rightful owner of the device.
  • Any terms or conditions referred to in a sales order by you, anywhere or at any time, have no effect.
  • Once we receive the device and it has been approved, we possess the full entitlement to sell, recycle and process the device at our will prior to any payment being made.
  • You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.
  • We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

We are unable to progress your trade unless you agree with all of the above.
4. Contract Cancellations and Returns
You are able to cancel the sale of a device and terminate the contract during the “cooling-off period”. In our case, the cooling-off period refers to the time frame between the agreement being formed by placing an order and the device being approved after the device has been tested (see section 6). During this specified period, you may cancel the contract with us at any time, given that all of the following is achieved:

  • The contract was negotiated and concluded exclusively by means of distance communication (including, but not limited to, telephone, letter or email).
  • The payment has not already been made for the device in full or in part.
  • We still have physical possession of the device.

If you wish to cancel your order within the cooling-off period, you need not give us any reason for cancelling the contract, nor will you have to pay any administration or return delivery charges. Simply, send an email to enquiries@moneyforyourphone.com with subject ‘cancel order’ and your order number.

Cancelling a contract outside of the cooling-off period is also possible at our complete discretion, providing:

  • The payment has not already been made for the device in full or in part.
  • We still have physical possession of the device.
  • You agree to and pay in full a return delivery charge of £6.00.

Your contract strictly cannot be cancelled outside of the cooling-off period if any of the above are breached.

The cooling-off period refers to individual devices and not the entire order. E.g. if an order consists of two devices, one device may be approved and therefore no longer in the “cooling- off” period, whereas the second device may be not be approved and therefore will be within the cooling-off period.

We will, however, return your device if, when we receive it, we find that it has a lesser value than originally stated such that we revise the value and you confirm that you do not wish to sell your device. These rights are explained in section 6. In such cases, we will send this to you via Royal Mail, using the Second Class Recorded Delivery service. We will also provide you with a tracking number. We accept no liability if this is lost in transit.

If Royal Mail cannot deliver the device, the device will be returned back to us. We will contact you via the email address you registered with to rearrange delivery. If we do not get a response from you within 7 days, we will pay the lower re-quoted value and the device will be retained and treated as our property. If the redelivery is arranged and the device is returned for the 2nd time, we will pay the lower re-quoted value and the device will be retained and treated as our property.

We do not guarantee any data will be on the device when it is sent back to you. Additionally, the condition and operation of the device is not guaranteed to be the same when we send it back. Please note that any accessories, memory cards, chargers, cables and boxes will not be returned and we will not reimburse you for your postage costs under any circumstances.
5. Conditions of Sale
You can place an order for a “working” device as well as “non-working” device. Please note, however, that non-working devices are worth much less to us and this is reflected in our website prices. All devices must match the make and model in the sale order and meet certain criteria to be classified as either a working or non-working device. Please see next sub-sections.
5.1. Working Devices
All devices must satisfy the following conditions:

  • The device must switch on and off and be in full working order, meaning that all features (i.e., calls, texts, earpiece quality, loudspeaker quality, vibration, camera features, connectivity (Wi-Fi and Bluetooth), touch screen, screen display, all buttons, and charging ability) are required to be functioning to manufacturer’s specifications.
  • The device must be fully intact with no missing or broken hardware (i.e., casing, batteries, bodywork, stylus, buttons, screen etc).
  • The LCD/screen of the device must be fully functional without cracks, screen burn, blank displays or pixel damage.
  • The device must not be water or liquid-damaged.
  • The device must have a genuine fully functional operating system with no custom ROMs installed (i.e., Apple devices should not be “Jailbroken”; Samung, HTC, Sony etc devices should not be “Rooted”).
  • If the device is a mobile phone, it must be registered within the UK.
  • The device must not have any active security or PIN codes that restrict its access.
  • All Apple devices with an “Activation Lock” must have this feature removed and be de-registered with their associated iCloud accounts.

By submitting an order for a working device on our website you warrant that your device complies with all of the above criteria.

On the other hand, if your device violates one or more of the aforementioned terms, it is classified as a non-working device and therefore you should place the order in this manner. However, should you still decide to place the order as a working device despite knowing that it is not fully working then we are obligated to take appropriate action and send you a revised quote via email and/or text, which corresponds to the non-working price of the particular device. In such cases, the revised quote may be lower in value than that listed on our website under “Non-Working”.
5.2. Non-Working Devices
If a device fails to comply with one or more of the criteria listed in the above section (i.e., cracked screen, faulty button(s), broken housing etc), the order should be placed as a non-working device. As such, all non-working devices must meet the following conditions:

  • The device must not be beyond economical repair (i.e., crushed or snapped in half).
  • The device must possess all internal parts and components (i.e., motherboard etc).

Please note that we may not be able to accept your device or that the value of your device may be reduced to zero should any of the terms relating to non-working devices be violated.,br/>
5.3. Physical Condition/Appearance
With particular relevance to working devices, we pay close attention to their physical condition. In order to receive the full indicative value for your device it must be clear of significant cosmetic damage. Significant cosmetic damage, as we describe it here, includes deep marks and scratches, chips and cracks, large dents, scuffed paint, and excessively worn buttons and/or housing, amongst others (i.e., noticeable physical defects such as mismatched casing, discoloration and engravings/permanent marks). In the event of such cosmetic damage, we are obliged not to pay as much the original indicative value and will send you a revised quotation for your device via email and/or text.

Please note that the terms relating to cosmetic damage only apply to orders placed for working devices. Thus, non-working devices with significant cosmetic damage will still be paid for in full provided that all criteria in section 5.2 are met.
5.4. Accessories
We don’t require any accessories such as chargers, boxes, SIM cards or memory cards etc. All we require you to send in is the phone and battery. If you would like to recycle any accessories, you can send them in, however they will not increase the value for the order.

  • We cannot return any accessories on any occasion as they are processed or disposed of upon receipt
  • We cannot reimburse you for any accessories that are sent in with the device.
  • Specialised chargers are not considered as an accessory, e.g. Samsung gear watch chargers
6. Testing and Revised Quotes
In all cases, tests are carried out prior to and are the conditions for, payment. All devices are tested for compliance with our terms and conditions, particularly in accordance to section 5 (5.1, 5.2 and 5.3). Most devices we receive comply with the terms and conditions and are approved and paid for in full as indicated in the initial order. However, sometimes we come across orders for working devices that are in fact faulty or in poor cosmetic condition, which violates sections 5.1 and/or 5.3 of our terms and conditions. For such devices, we will send out a revised quote via email and/or text, which accounts for the specific defects. You will then have three working days to respond to this email/text to either accept or reject the quote. If you choose to accept the quote, the device will be approved and the sale will progress. Conversely, if you choose to reject the quote, it may be negotiated or rejected, in which case we will return the device free of charge.

If you do not respond within three working days, starting on the day on which we sent the revised value, we will automatically process your sale after that time, using the new price. We will send an SMS text reminder on the second day to the mobile number which you provided during registration, in order to remind you again.

Devices are tested and approved individually, if your order consists of more than one device you will need to accept or reject the quote for each device. If you choose to reject the quote for one device, we will only return that specific device. We cannot return devices that have been approved within the same order as explained in section 4.

We accept no responsibility if the revised quotes are not received due to incorrect contact details.
6.1. Incorrect Models
As mobile phones/devices can look similar, customers sometimes incorrectly identify them. If we find that the model you send is not as referred to in your sales order, we will e-mail a revised value for the actual device, confirming the model. You can then choose to either continue the sale for the revised value or reject it, in the same manner as that stated in above section (section 6).
7. SIM Cards and Data Removal
All SIM cards and personal data including all names and contacts, SMS messages, photos, games, and other multimedia must be removed from your device before it is sent in to us. This is a fundamental provision in our agreement. We advise you to ensure that you understand and comply with the following conditions:

  • We will not accept liability for any loss, damage or costs which you incur if the SIM card, memory card or other media are sent with the device or if personal data remains on the mobile phone/device including without limitation, any charges which you incur as a result of use of your mobile phone/device by any person, whether incurred before or after our receipt of the device.
  • We will not be in any way responsible for the security, confidentiality, protection, use or disclosure of any personal data which you fail to remove or any losses or costs which arise as a result.
  • If you send a SIM card, memory card or personal details in error or in breach of this section, we will not under any circumstances be able to return them to you and shall have no responsibility in respect of them.
  • Any data stored or contained therein or on any media used in conjunction with the device (whether in the form of personal details, SMS, photos, games, songs or other data) will be deleted.
8. Lost, Stolen, Barred/Blocked Devices
We work with 'Immobilise', a crime protection database that blocks lost or stolen mobile phones. Thus, we check the status of all mobile phones/devices received against the National CheckMEND database to ensure that they have not been reported as lost or stolen. However, in the event that we become aware of any issues at any time, we reserve the right to withhold payment and you agree to co-operate with us and any authorities should we so request.

If your mobile phone/device is found to be registered as lost, stolen or barred/blocked on the CheckMEND database, it will fail our due diligence process in which case your device will be quarantined for 28 days while its status is reviewed. The purpose of the quarantine period is to allow the rightful owner the opportunity to “unblock” the mobile phone/device so it can be processed appropriately.

If you are advised that your mobile phone/device has been reported as lost or stolen, you will need to contact CheckMEND in order to review the status of your mobile phone/device. You will be advised of the procedure required by email from us. If you or any previous owner has blocked the phone with a UK network, made an insurance claim or reported the item stolen then you need to speak to the relevant party and ask them to unblock the device and then contact CheckMEND.com and ask them to update their information.

If the quarantine period has expired and the device is still registered as lost or stolen on the CheckMEND database then we are required by law to dispose of it and you will not receive any payment. We cannot under any circumstances return the mobile phone/device or pay any money towards it during the 28 day quarantine period unless the device has been unblocked. To do either would risk offences under The Theft Act or Proceeds Of Crime Act.

If, during the quarantine period the device becomes unblocked, your device will be retested and processed as normal and will not be returned. If the value of the device has dropped significantly from when the device was received and when the device was unblocked, we will send you a re-quoted price which you will have the option to accept or reject as per section 6.
If you have chosen to swap your device for another mobile phone/device, your order will only be valid once you comply with all the following conditions:

  • Any additional difference in price you owe us must be paid before the device you chose to swap your device for, is sent out to you.
  • If the device you sent in fails to comply with the terms and conditions relating to the functionality and/or cosmetic condition (sections 5.1, 5.2 and 5.3) and you are sent a revised quote of its value to us, you will be required to pay the additional difference in price for the device you wish to swap with.
  • Devices will only be sent to the address on the account.
  • Money For Your Phone Limited has the right to reject a SWAP deal without any reason.
  • The total number of devices which you have sent in to contribute towards the exchanged device does not exceed 10.
  • Once you receive the SWAP device you have a 14 day refund/exchange period. The original device will not be returned, however the value of the device will be paid if a refund is requested.
  • The device you wish to SWAP your device for will come with NO accessories, box or chargers unless stated on our website at the time of placing you order.
  • The device will be a used device and may have minor signs of use, but overall it will be in great condition.
  • Devices are not reserved when you place a swap order. Devices are subject to availability at the time your device is tested.

By submitting an order to swap your device through our website you warrant that you understand and comply with these terms.
10. Payment
Payments will only be made to the details provided on your account. We aim to issue payment within 7 working days from the day in which we received your device, given that it meets all criteria in sections 5.1, 5.2 and 5.3.Once payment has left our account it may take up to 3 working days for it to clear into your account, depending on who you bank with. With some banks, payments clear instantly. Others can take up to 3 working days. This is strictly out of our control.

  • We will not be liable for delay in your receipt of payment as a result of third party action or inaction or once we have issued payment. Timescales are indicative only and we do not guarantee to meet them.
  • We accept no liability for any fees incurred by third parties including your bank and Paypal for receiving a payment.
  • Under no circumstances will payment be made before we receive your mobile phone/device.
  • We accept no liability for any delays in your payment due to incorrect details and if this is the case, we will contact you. Once you provide us with the correct details, we will try your payment again.
  • If payment is successfully made to an incorrect bank account provided by you by mistyping or for any other reason, we will not make another payment until the original funds are returned and cleared in our account.
  • We will not be liable or responsible for any failure to perform, or delay in performance, or any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
10.1. Same Day Payment
If you have placed an order as “Same Day Payment”, you must comply with all the following conditions:

  • Same day payments apply to the day the device is tested and not the day it is received.
  • Same day payments apply to orders where they are tested before 4:00PM on a working day. Any order tested after this period will be paid on the next working day.
  • We accept no responsibility for any delays caused by third parties (i.e., banks) or the user providing incorrect details, as stated in section 10.
  • If your device fails to meet the criteria listed in sections 5.1 and 5.3 for a working device or section 5.2 for a non-working device, a same day payment will not be issued. Payment will be made once a price has been agreed and the order has been approved.
  • If your device is found to be barred/blocked, same day payment will not be issued and the device will be processed as per section 8.
  • Normal orders cannot be amended into “Same Day Orders”
11. Pricing
Prices offered on our website are subject to change at any time without notice. When your order has been placed, the price quoted is guaranteed to remain valid for 14 days from the 'Order Created’ date. If your device is received after 14 days from the 'Order Created’ date, the up-dated, current prices will apply if it is lower. If the price is greater at this time you will still get the lower, original price.

Please note that device values on our website are indicative only and we are not obliged to pay the initially quoted value for devices that do not comply with sections 5.1, 5.2 and 5.3, and thus require revision.
12. Postage and Freepost
A freepost envelope can be sent out to you upon request, but this does not insure the value of the items. We accept no liability of loss or damage to devices before we receive them. All devices are sent at the risk of the sender. Thus, we advise you to securely pack your device to reduce risk of damage and strongly recommend that all mobile phones/devices, regardless of value, are sent by Royal Mail Special Delivery (which will be at your own cost).

If you do not receive your freepost envelope you can request another one by contacting us via the "contact us" page.

If you claim that the order has been posted, but we do not receive it, we will request you to provide proof of delivery via signature or online tracking. If it turns out that your device has been lost in the post, we will advise you on how to make a claim against Royal Mail. However we do not guarantee this to be successful.
We will not be in any way responsible to you for the following:

  • Failure to purchase your device.
  • Failure to comply with our obligations under these terms and conditions.
  • Costs or liabilities which you incur as a result of any circumstances beyond our reasonable control including but not limited to act of God, flood, fire, trade dispute, lack of third party materials or services or terrorism.
  • Errors made whilst creating an order and entering details online or over the phone.

The agreement between us is binding and you must agree to the following conditions:

  • You may not transfer or assign your rights or obligations to another person without our express agreement.
  • We may transfer or assign our rights and obligations under the agreement or appoint third parties to assist us to perform our obligations.
  • If any of these terms are found to be void by a professional body or competent authority, all others will continue to apply.
  • We reserve the right and entitlement to change our business procedures, practices, terms and conditions, standards and policies at any time without notice. This makes it easier for us to adhere to and comply with changes in industry standards, guidelines and rules.
  • If either party (we or you) does not act on any right within these terms and conditions, then it will not affect the rights of either party to enforce our rights at a later stage. If either party decides not to rely on a right we have, it will not affect any of the other rights either of us have.
  • These terms and conditions and the agreement between us are subject to English law and we each agree that any dispute arising under or connected to it will be decided by the English courts.
  • No changes to the terms and conditions will bind either of us unless we agree in writing but mobile phone/device value changes constitute a change to the agreement and will be deemed to be in writing.
  • We may amend the terms and conditions at any time, without notice. Any change takes effect immediately after it is posted on the website and will be deemed to be accepted by any person using the website. Where you have already placed a sales order which we have accepted, the agreement between us is subject to those terms and conditions in place at the time we confirmed your sales order.
  • The agreement between us will end once each device transaction is complete, although any terms and clauses regarding SIM cards, blocked/barred devices and any other terms relative to the purchase of the device and personal data, as well as all exclusions of our liability and any other provisions capable of having effect after the agreement ends, will continue to apply thereafter.
  • These terms and conditions and our privacy policy form the entire agreement and understanding between us in respect of their subject matter and will supersede and replace any prior agreements, understandings or arrangements, written or verbal.
  • We each acknowledge that by entering in to this agreement, neither party relies on any representation, promise or by anything implied from anything said or written other than these terms and conditions.
  • Details concerning the sale of your device will be kept in our records.
  • Nothing in our terms and conditions seeks to exclude or limit any rights available under applicable law which cannot be excluded or limited. Any rights granted to you by law or that which the law does not allow us to change or limit are not changed or limited.
  • A person who is not party to our terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms which means that only we and you have rights under them. This does not affect any right or remedy of any person which exists or is available otherwise than under that Act.
  • All content on our website including images, text, terms and conditions, addresses, details, links and pages are the copyright of Money For Your Phone Limited. You do not have the permission or right to use any content from our website.

All correspondence or notices to us will be deemed delivered as follows depending on how you send it:

  • If delivered by hand, it will be considered as delivered the day it is left with us.
  • If sent by post, it will be deemed to be delivered the day it is received by us.
  • If sent via email, it will be deemed delivered on the day it is sent correctly.

Applicable laws require that some information and communications be in writing. However, when using this website, you accept that communications will be mainly electronic. We will contact you by email or by providing you with information by posting notices on our website. For contract purposes, you agree to this electronic means of communication and acknowledge that:

  • All contracts, notices, information and other communications that we provide electronically, comply with any requirement that communications be in writing. This does not affect your statutory rights.
  • You can check your emails on a regular basis for updates on the sale of your mobile phone/device.
  • We do not accept responsibility for any emails which are not received successfully, where the email address is incorrectly spelt or that are redirected or deleted by spam filters.
14. Complaints Procedure
We aim to provide the highest level of customer service and care when dealing with you. We always strive to better our service and this helps us offer you better prices. If for any reason you are not fully satisfied then you have the right to complain.
